Supreme Court seeks Centre’s stand on plea challenging Rohingyas’ deportation
http://www.timesnownews.com/india/article/supreme-court-rohingyas-muslims-centres-deportation/85493
New Delhi: The Supreme Court sought to know the stand of the Govt on a petition challenging its decision to deport illegal Rohingya Muslim immigrants back to Myanmar. The matter came up before a bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud which asked Additional Solicitor General Tushar Mehta to take instruction from the Centre for its response to the petition which has challenged the decision on various grounds including that it violated international human right conventions. While the bench posted the matter for Sept.11, advocate Prashant Bhushan, appearing for 2 Rohingya immigrants, wanted an assurance that during the pendency of the petition, the Centre will not take any step including the deportation of the immigrants.ASG made it clear that he was not making any statement. The bench asked the petitioner to hand over the copy of the petition and relevant documents pertaining to the matter to the law officer. Many of them, who had fled to India after the earlier spate of violence, have settled in Jammu, Hyderabad, Haryana, UP, Delhi-NCR and Rajasthan. The plea, filed by 2 Rohingya immigrants, Mohammad Salimullah and Mohammad Shaqir, who are registered refugees under the UNHCR, claimed they had taken refuge in India after escaping from Myanmar due to widespread discrimination, violence and bloodshed against the community there. "Proposed deportation is contrary to the constitutional protections of Article 14 (Right to Equality), Article 21 (Right to Life and Personal Liberty) and Article 51(c) of the Constitution of India, which provides equal rights and liberty to every person. "This act would also be in contradiction with the principle of 'Non-Refoulement', which has been widely recognised as a principle of Customary International Law," the plea said, while seeking a direction to Govt not to deport them and other members of Rohingya community. It has also sought a direction that Rohingyas be provided "basic amenities to ensure that they can live in human conditions as required by international law".PTI

Israel arming Myanmar amid ongoing Rohingya violence
http://www.middleeasteye.net/news/Israel-arming-Myanmar-amid-ongoing-Rohingya-crackdown-478788243
Israel has continued to sell weapons to Myanmar as thousands of Rohingya refugees flee the military's violent crackdown in the Rakhine state. The weapons sold to Myanmar include over 100 tanks, weapons and boats used to police the country's border, according to human rights groups and Burmese officials. Israeli arms companies such as TAR Ideal Concepts have also been involved in training Burmese special forces who are currently in the Rakhine state where most of the violence has taken place. Images previously posted on the arms company's website showed its staff instructing members of the Burmese special forces on combat tactics and how to use specific weapons. In September, the Israeli High Cof Justice is expected to hear a petition, launched by activists, urging the Israeli Govt to stop arms exports to Myanmar. US and EU have an arms embargo against Myanmar. Eitay Mack, the lawyer presenting the petition, told Middle East Eye that Israel has "no control" over its arms exports once they are sent overseas. “Israel has no control of what's happening with its weapons once it sends its weapons to Burma,” said Mack, an Israeli human rights lawyer based in Tel Aviv. “But from TAR Ideal’s website, we know that they are arming and training Burmese special forces who are operating in the Rakhine state right now."The petition was submitted in January, following visits by Israeli officials to Myanmar to discuss arms deals, and vice versa. After the petition was submitted, the Israeli defence ministry in March said the court had no jurisdiction over the issue and claimed that arms sales to Myanmar were "clearly diplomatic". Israel has shared a strong relationship with Myanmar and maintained trade relations over the years. These relations existed before the military junta stepped down. Ofer Neiman, an Israeli human rights activist, said Israel's relationship with Myanmar is linked to its ongoing occupation of Palestinian territory in the West Ban. middleeasteye

The report attributed the deaths to “perinatal asphyxia”, a condition in which the child cannot breathe properly. “It was amply clear that most children died because of lack of oxygen,” Jain said. UP Govt has ordered an investigation into the incident, which is expected to be conducted on Tuesday. New Delhi:Loudspeakers can blare in Mumbai during the Ganpati Visarjan festivities on Tuesday, with the Supreme Court on Monday staying a High Court order banning their use in the state. The Bombay High Court on Sept.1 had granted an interim stay to a recent amendment to the Noise Pollution (Regulation and Control) Rules that led to the elimination of 1,573 notified ‘silence zones’ in Mumbai ahead of festive season.A bench headed by Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud issued notice to the social activists on a plea of state Govt and stayed the Sept.1 order of high court. It sought a reply from the activists in favour of the ban within 2 weeks and restrained the HC from passing any further orders in the matter.Additional Solicitor General Tushar Mehta, appearing for state Govt , said the high court has erred in staying the rules which cannot be done.“If these all India rules are implemented in a literal sense, then you cannot use loudspeakers near a small clinic, school or even court premises which will virtually make the entire country go silent,” Mehta said.Senior advocate CU Singh, appearing for some social activists, said the high court was justified in staying the rules and even the SC has in the past stayed them. The bench asked Singh as to what will be the impact of this ban in the state. The senior advocate said then Govt allow processions during Ganesh Visarjan revelry with loudspeakers being played.Mehta said if we go strictly by these nationwide rules, then no function can be held even at the SC lawns. The bench said it will look into the matter.PTI

Remove 'assaulter' Minister Anant Hegde from Cabinet, Indian Medical Association urges PM

The country may have celebrated India’s second Defence Minister Nirmala Sitharaman, cutting across party lines. But not everyone is happy with all the Ministers inducted on Sunday. Doctors across the country are up in arms against the new Minister of State for Skill Development and Entrepreneurship from Karnataka, Anant Kumar Hegde. The Indian Medical Association has even gone so far as to write to PM demanding that Anant Kumar be dropped from the cabinet immediately, reported India Today.Anant Hegde’s induction into the Union Cabinet came as a surprise to many, as he had been caught on camera assaulting doctors at the Totagarara Seva Samiti Hospital in Sirsi just a few months ago. The MP was angered at what he said was negligent care of his mother, and was seen harshly abusing doctors and manhandling them.In the letter, the IMA has said that Anant Hegde’s appointment clearly sends out a very wrong message.“Instead of taking action or conducting a probe, he has been inducted into the cabinet. Making him Skill Development Minister has sent another wrong message. Is indulging in violence the ‘new skill’ to be taught to entrepreneurs?” the letter from IMA was quoted as asking.

New Delhi: Ex-RBI governor Raghuram Rajan has revealed that he did not favour demonetisation as he felt the short term economic costs associated with such a disruptive decision would outweigh any longer term benefits from it.Rajan makes the disclosure in his latest book – I do what I do – which is a compilation of speeches he delivered on a wide range of issues as RBI governor. Although he maintains the book is not a tell-all, the short introductions and postscripts accompanying the pieces offer fascinating insights into his uneasy relationship and differences with the present Govt .“At no point during my term was RBI asked to make a decision on demonetisation,” Rajan has said, putting to rest speculation that preparations for scrapping high-value banknotes got underway many months before PM Narendra Modi made the surprise announcement on Nov.8.This is the first time the former RBI governor has spoken on demonetisation since demitting office on Sept.3 last year. Rajan, who now teaches economics at University of Chicago, said he chose not to speak on India for a year because he didn’t want to “intrude on his successor’s initial engagement with the public”.“I was asked by the Govt in Feb.2016 for my view on demonetisation, which I gave orally. Although there might be long-term benefits, I felt the likely short-term economic costs would outweigh them,” Rajan wrote. “I made these views known in no uncertain terms.”HT

A video from a recent debate with a former RAW official, RSN Singh, insulting Prophet Muhammad (PBUH) has now gone viral on social media platforms causing considerable anger among Muslims. In the video, Singh, who’s known for his bigoted views and a regular panelist on Times Now on debates concerning Kashmir, Pakistan and anti-Muslim issues, uses derogatory language for the most revered personality in Islam after God. He then goes on to make insane and factually incorrect comments about the the revered wife of the Prophet(PBUH) accusing her of having murdered Hazrat Ali, one of the caliphates of Islam, and his sons.Singh is described as an intelligence expert, who has reportedly served in the Indian army and RAW in the past. He’s usually seen shouting loudly and losing his temper while indulging in brawls with fellow panelists- an act not approved by even people who share the same bigoted views on social media. New Delhi: National Broadcasting Standards Authority has directed Zee News to issue a public apology and pay a Rs. one lakh fine following a complaint that objected to the channel branding Raza as part of an ‘Afzal Premi Gang’ for reciting his poems in the ‘Shankar ‘ Shaad Mushaira.’ The NBSA has awarded the highest punishment in its jurisdiction, reaffirming that big media houses cannot trample over the rights of citizens to freedom of speech and expression, which includes the right to dissent.Raza was branded as part of an ‘Afzal Premi Gang’ on a Zee show Afzal Premi Gang ka Mushaira – which first aired on March 9 with multiple telecasts over the following days. The programme was based on the annual Shankar-Shad Mushaira that took place in New Delhi on March 5 -- it was a poet’s conclave where Raza had recited several poems. Raza says that the Zee programme telecast only selective portions of certain poems and went on to brand him as an “anti national” based on a prejudiced and baseless line of reasoning. Following NBSA order, a press release states:“Gauhar Raza, an eminent scientist and poet, was maligned, defamed and hate engineered against him by the malicious, concocted and motivated news telecast carried by Zee News in March, 2016. Raza was branded as a part of an “Afzal Premi Gang” for reciting his poems in the ‘Shankar - Shaad Mushaira’. A complaint was then filed by Raza with News Broadcasting Standards Authority against Zee News along with another joint complaint filed by eminent artists like Mr. Ashok Vajpeyi, Ms. Shubha Mudgal, Ms. Sharmila Tagore and Dr. Syeda Hameed. Advocate Vrinda Grover arguedf on behalf of Gauhar Raza and other complainants. The Citizen

Lucknow:UP Shia Wakf Board president Waseem Rizvi believes there is nothing wrong with allowing the construction of a Ram temple at the site of the erstwhile Babri Masjid in Ayodhya as long as it promotes the cause of communal harmony. Rizvi visited Ayodhya over the weekend to meet many prominent saints and present his new formula, which advocates: “Come construct the temple and spread harmony”. He said that while the temple can be constructed at the supposed birthplace of Ram in the religious city, a mosque with the title ‘Masjid-e-Aman’ may be set up at a Muslim-populated locality in the neighbourhood.Rizvi was accompanied by Mahiradhwaj Singh alias Murari Das, convenor of Rashtriya Muslim Manch (minority wing of RSS), during his visit. The duo met several mahants, including Dharam Das, Suresh Das, Kamal Nayan Das and Bhaskar Das, to evolve a consensus on the proposed formula. hindustantimes

Araria (Bihar):The policemen looked bored and the parents who had gathered at the police station were panic-stricken, as their teenage sons sulked behind the bars of the lockup in this sleepy rural district headquarters along the Nepal border.“Ma tum jao ... just leave,” a skinny young man in a saffron vest shouted as his teary-eyed mother tried to negotiate the release of her son.Several parents nervously peered at a policeman’s phone as he played footage of the violence from the night before when an mob of hundreds of angry Hindu men lit a fire not far from National Highway 57, blocked traffic, and pelted stones at a convoy of policemen to protest against the alleged sacrifice of a cow on Eid ul-Adha.While approximately 30 people were initially detained for questioning, Dhurat Sayli Savlaram, Araria’s superintendent of police, said a total of 13 people — both Hindu and Muslim — had been arrested for cow slaughter, and for rioting.A month after Bihar CM Nitish Kumar dumped his former ally and formed a new Govt by forging a mid-term alliance with the BJP, experts say the events in Araria reveal how BJP and its affiliates are leveraging their influence in the state Govt to expand their muscular brand of Hindutva to regions where they had no previous presence. On the first day in his new office as tourism minister, bureaucrat-turned-politician Alphons Kannanthanam touched upon the controversial issue of beef, saying it would continue to be consumed in Kerala. The 1979 Kerala cadre officer said that the BJP had never said that beef cannot be eaten.“As Goa CM , Manohar Parrikar has said that beef will be consumed in the state. Similarly, it will be consumed in Kerala,” he said.“BJP does not mandate that beef cannot be eaten. We don’t dictate food habits in any place. It is for the people to decide,” he said. Kannanthanam said if a BJP-ruled state like Goa was eating beef, there should be no problem in Kerela. He later told a TV channel that he act could be a bridge between the Christian community and the BJP.Addressing some of the concerns that were raised by the Christian community about the BJP in the past, Kannanthanam said it was mere propaganda.PTI

Barabanki: Access to laptop and internet has transformed the way students acquire education in many madrasas of UP and improved their participation, Islamic institutes’ teachers and officials said.Barabanki-based Noorul Makatib madrasa witnessed a fall in student dropout rate after it got 5 laptops with internet connection in 2014 as part of Tata trusts’ Technology in Education (ITE) initiative.“Earlier, we had to persuade students to come to school but now they eagerly attend classes. It is heartening to see the way technology is being used by students,” said madrasa head Mahmud-ul-Haque. Students of Class 4 and above are given access to a laptop to find out about history and geography of Indian cities, dietary components in their food and contribution of personalities, said madrasa teachers. To ensure that the students use the laptops for education purposes only, officials have denied them access to different social media sites.“Exposure to internet has connected the students to the outside world. It has made them feel that they are at par with students from metro cities,” Haque added.

New Delhi: Sangh-backed ABVP has fielded one of its four activists, who assaulted JNU student Najeeb Ahmed before he went missing last October, for the JNU students union polls this week.Ankit Roy was among the four "found to be involved in hitting" Najeeb by a proctorial inquiry. As disciplinary action, they were transferred to other hostels, leading to protests by students and teachers against the "mild punishment".While the Lyngdoh Committee's recommendations on student elections, binding on all varsities, prohibits those who have faced disciplinary action from contesting, JNU's election committee is unable to disqualify Roy as the chief proctor's office has refused to share the inquiry report.Roy has been fielded for a councillor's post from the School of Language, Literature and Culture Studies.ABVP has maintained that it was Najeeb who had assaulted Roy and others during a campaign for a hostel poll last year. telegraphindia

Kolkata: Uluberia MP and senior Trinamool Congress leader Sultan Ahmed passed away in the city on Monday after a cardiac arrest, prompting CM Mamata Banerjee to mourn his "untimely death" and say CBI had put him "through a lot of tension".Ahmed, Trinamool's moderate Muslim face who had under his thumb almost every Kolkata Muslim socio-cultural organisation that mattered, was 64. He breathed his last at his Ripon Street residence."I got information that when his body was being taken, a CBI notice was served. There was some Narada case of Rs 1-Rs 1.5 lakh... he was under extreme stress...it was not his age to die... we are all very saddened," Banerjee said a few hours after tweeting: "Shocked and deeply saddened. He was my long-time colleague."Trinamool all-India general secretary Subrata Bakshi echoed the CM. "It takes four decades to get established in politics but not even 40 minutes to sully that," he said. "Politics has now become such that even an established politician like him had to struggle. He went through a lot of tension. Trinamool family is deeply saddened," Bakshi said. "The ruling party at the Centre was not able to compete politically. In the name of an investigation, he was put under pressure for 7-10 months," he added.CBI's Sept.1 letter was addressed to Iqbal Ahmed, Sultan's brother and KMC deputy mayor, asking him to appear before the agency's Nizam Palace office on Monday at 11am. The letter was received at Iqbal's Ripon Street apartment in the morning. Ahmed, who led a very disciplined life after his angioplasty 10 years ago, had shown little sign of any physical distress, family sources said. He reported unease around 11.15am and even before he could be taken to the Belle Veu Clinic, he died within the hour.Ahmed is survived by his wife Sajda Ahmed and two sons. The eldest, Taha Ahmed is a Delhi-based orthopedic surgeon and the younger Sharique is pursuing his post-graduation in business administration. timesofindia
