Muslim women body moves Supreme Court supporting triple talaq

New Delhi: At a time when the Centre has yet to make its stand clear before the Supreme Court on the practice of triple talaq, a voluntary organisation -- Muslim Women Welfare Organisation – on Tuesday filed a plea supporting the age-old practice. The Muslim Women’s Welfare Organisation, a Delhi-based organisation, filed the plea through advocate, MR Shamshad, saying so far as the divorce is concerned the Muslim women have equal right the way men have.Concurring the stand taken by the All India Muslim Personal Law Board (AIMPLB), it said that with regard to divorce, the Muslim women have much stronger rights than Muslim men which is called ‘Khula’.“The right of Muslim men to Triple Talaq is a balancing act to the right of Muslim women to Khula. If the Triple Talaq is struck down, it would affect the free will of Muslim women as well”. For polygamy, it said a woman can seek divorce under the Dissolution of Muslim Marriages Act.3 women have already moved SC against triple talaq saying the practice is discriminatory and violates their fundamental rights.Referring to the Dissolution of Muslim Marriages Act, the women’s organisation said so as far as practice of polygamy is concerned, Section 2 (viii) of the Act sufficient.A woman can make polygamy as a ground of divorce if husband does not treat her equitably in accordance with the injunctions of the Quran.“Thus, it is inappropriate to say that Muslim women are meted out with cruelty when their husbands bring second wife and they are left without any remedy. Further, the rights of Muslim women are protected by virtue of Muslim Women (Protection of Rights on Divorce) Act.Earlier, the SC had sought a reply from the govt on the issue. Hyderabad: A city based Muslim women's organisation is all set to implead in cases at the Supreme Court pertaining to the controversial provision of oral triple talaq and gender discrimination faced by Muslim women.Muslim Mahila Research Kendra (MMRK), headed by Dr Asma Zehra who was involved in the rehabilitation of victims of the 2002 Gujarat riots, has sought to implead in the cases maintaining that Muslim personal laws are not the domain of the judiciary. The stand comes across as the opposite of what some other Muslim groups have been demanding - the abolition of oral triple talaq.Talaaq issue has been totally misunderstood by both Muslims and Non-Muslims."We have already filed relevant paperwork to implead in the cases. We believe that personal laws are not the domain of courts of law. Experts and scholars of Islam should decide cases of oral triple talaq," Dr Zehra said. Terming the movement against oral triple talaq a "propaganda against Muslim community," she said, "legislation against oral triple talaq is not the solution. A social reform is required. The safety of women is required." Launching a salvo against other Muslim women groups who are against oral triple talaq, she claimed that they do not have requisite knowledge of Quran, hadith (tradition of Prophet) and lacked expertise on the subject. Dr Zehra, who is also a member of the AIMPLB, further said that neither the judiciary nor the legislature can choose and pick which parts of the Muslim personal law to retain or remove. "They (judiciary and legislature) have to respect all schools of thoughts and religions. AIMPLB is a body which represents all makaatib-e-fikr (schools of thought) of Islam," she said. She claimed that countries, such as Pakistan, Bangladesh and Saudi Arabia, where oral triple talaq is not permitted, should not be cited as an example as there are other laws working in conjunction with others. Muslim Family Laws Ordinance in Pakistan provides that all marriages be registered which is largely not seen in India, she said.MMRK has embarked on a signature campaign which seeks to make a case that Muslim women are safe and content with Muslim personal laws and are against any interference in the Sharia, which includes the introduction of a Uniform Civil Code.timesofindia

Chennai: A PIL has brought to light the functioning of several hundred 'courts' run by advocates and religious heads at many mosques in Tamil Nadu, including one on Anna Salai in Chennai. Calling them kangaroo courts that follow neither sharia nor regular law, the PIL said hundreds of divorces are granted whimsically. They dabbled with property disputes too, it said. The first bench of Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan has issued notices to the Tamil Nadu home secretary, the director general of police and the Chennai city commissioner of police on the matter.When the PIL, filed by Abdur Rahman, an MBA holder from UK, came up for admission on Wednesday,his senior counsel A Sirajudeen said it had been filed to safeguard the interests of a large number of innocent Muslims who were silently suffering because of the functioning of Makka Masjid Shariat Council and similar forums across the state."Because of illegal functioning of the council, the family systems of a number of Muslim families have collapsed and hundreds of spouses suffer the ignominy of separation because of their poverty," the PIL said.TOI

Lucknow: Chand Khan alias Shan Khan spent 11 years in jail in the 2002 Akshardham temple attack case before the Supreme Court in 2014 acquitted him along with five others. Two years after he walked free, Khan has landed in jail again, this time for alleged cow slaughter.In July 2006, a trial court had sentenced Khan to death in the Akshardham case and the Gujarat High Court had upheld the sentence. In May 2014, after the Supreme Court acquitted Khan and the others, he walked out of Sabarmati Jail and went back to his family in Bareilly. But since June this year, Khan has been in Pilibhit district jail after a case under the Cow Slaughter Act was filed against him at Beesalpur police station in Pilibhit. According to police, on June 15, sub-inspector Shyam Singh Yadav, who was leading a vehicle inspection drive, stopped a car at Nawadiya Sitarganj locality in the Beesalpur police station area. The police, who claim to have recovered 500 kg of beef, arrested three persons — Shan Khan, Ateeq and Faizan, all residents of Kakartola in Bareilly — and registered a case against them under the Cow Slaughter Act. Police also seized the Maruti Zen in which the accused were travelling. While police claimed that Khan did not tell them that he also went by the name Chand Khan and that he had been arrested in the Akshardham case, his family alleged that police were falsely implicating him and that his “background” had come to haunt him. Top sources in Gujarat police, however, confirmed Khan’s identity. Khalid Shaikh, who represented Khan in the Ahmedabad trial court, said the court convicted him of helping the two terrorists “by bringing them to Ahmedabad and taking them around the city”.“However, the Supreme Court acquitted him of all those charges by trashing the prosecution case and saying it did not have sufficient corroborative evidence. New Delhi: OIC contact group on J&K which held a special meet at New York, did not take note of the attack in Uri. Official sources however told The Hindu that they have noted the strong support that Turkey and Azerbaijan extended to Pakistan during the meet which called for “cessation of violence” in Kashmir.The meeting was attended by the member countries of OIC where Pakistan was represented by Sartaj Aziz, Advisor on Foreign Affairs of PM Nawaz Sharif.Ministry of External Affairs is yet to formally respond to the staunch support extended by Turkey and Azerbaijan to Pakistan during the meet which criticised India.“Foreign Ministers of Azerbaijan and Turkey expressed grave concern at the deteriorating situation in the Indian occupied J&K. Tajamul, an associate of Jama’at was erstwhile harassed by police and SOG at many occasions, the statement said. New Delhi: As investigators gather evidence from the rummage left after the Uri attacks, the NIA plans to conduct DNA test from samples of the 4 slain militants who were buried near the attack site on Monday.NIA which registered an FIR on Tuesday said that the DNA samples will be the key in helping them identify the Pakistani nationals like in the Pathankot case. The reports will be used to pressure Pakistan internationally. Officials said their photographs would be shown to JeM cadre lodged in jails to zero-in on their identities. Agency sources said NIA would adopt a 2-pronged strategy to investigate the case: One to find out how Army lines were breached and whether there were any insiders passing on crucial information to the enemy. The second would be investigation into the perpetrators of the attack. It is possible that the militants received local support using which they managed to gain entry into the airbase by cutting the barbed wire, the official added. "We are examining all possibilities and role of an insider cannot be ruled out," said a senior NIA official adding that the four militants had some local support that may have been arranged by their handlers. Last week, she lost her son, who was allegedly assaulted by some “2002 riots gutted my house, and now cow vigilantes have taken away my son,” she said on Tuesday.Merajbanu’s son Mohammed Ayyub, 29, was beaten up, allegedly by a group of cow vigilantes, on Sept.12 night, on the eve of Bakr Eid. He died in hospital four days later. Police said two calves were found from Ayyub’s car, one of which died on the spot. Police filed three FIRs: against unnamed people for attempt to murder (turned into a case of murder following Ayyub’s death); the second against Ayyub and one Samir Shaikh, who was in the car, under laws dealing with cruelty to animals; and the traffic police lodged the third FIR against Ayub for rash driving. Surat: The organisers of two garba events in Gujarat’s Bharuch district have decided not to allow Muslims at the venue after protests from the VHP. New Delhi: Refusing to grant police custody, a Delhi court on Wednesday sent AAP MLA Amanatullah Khan, arrested in connection with a sexual harassment case filed against him by his sister-in-law, to judicial custody till Thursday. Metropolitan Magistrate Vijeta Singh Rawat remanded the legislator to judicial custody after he filed a bail application, which would be heard on Thursday.Police sought two days custody of Khan, who was arrested Wednesday afternoon, saying he was required to be interrogated. The court, however, refused to grant police custody for the time-being and sent him to jail for a day.Police said Khan was called to join investigation at the office of DCP (Southeast) and was arrested on charges of sexual harassment and criminal intimidation.However, Khan tweeted claiming he was called for a “general discussion” at the DCP office but was arrested. He had alleged that he was “being framed by the police” which is “under pressure” to arrest him.PTI

Aligarh: Aligarh Muslim University today cancelled the election to the varsity's Students' Union, which was scheduled to be held on September 27, citing "disturbing situation" due to the participation of expelled students and "criminals" during the poll campaign. The decision to cancel the election was taken at a specially convened meeting of the university's Executive Council in view of the "extraordinary situation" which had developed during the campaigning in the past few days, AMU Registrar Professor Asfar Ali Khan said in an official notification."A disturbing situation has developed following the participation of expelled students, criminals and non-students during the campaign. There are also reports that contestants and their supporters have been making forcible entries with vehicles into the Women's College and other Halls of residence and classrooms," the notification said. "There are reports of blatant violation of the AMU Students' Union amended regulations 2012, which are based on the recommendations of the Lyngdoh Committee," it said. He is survived by two sons and a daughter. His mortal remains were laid to rest at Batla House graveyard here amid tearful adieu by scores of mourners, including Maulana Syed Ahmad Bukhari of the Jama Masjid. Tahboub is a member of an electoral coalition called the "National Coalition for Reform" that includes - besides Islamists like herself - Jordanian nationalists, Christians and members of other minority groups. "Our Coalition will work to express the best interests of the public, not certain interest groups," Tahboub said. "The current election law is designed by the govt so as not to give any political group any majority seats in the parliament," she explained. Yangon: A senior govt official in Myanmar’s troubled Rakhine State has pledged to tear down all illegally constructed uildings including mosques and Muslim religious schools, according to a report Wednesday.More than 3,000 structures including 12 mosques and 35 madrasas (religious schools) built without permission from local authorities in the majority Muslim townships of Maungdaw and Buthidaung in Rakine’s north are facing demolition, the local Voice Daily newspaper reported.Rakhine’s security and border affairs minister, Col. An air raid carried out overnight by Syrian or Russian warplanes killed four medical workers and at least nine rebel fighters near Aleppo, the Syrian Observatory for Human Rights monitoring group said on Wednesday.The raid hit the town of Khan Touman southwest of Aleppo city, an area controlled by insurgents. The British-based Observatory said the rebels killed were from the Islamist alliance Jaish al-Fatah.The medical staff killed were working for the Union of Medical Care and Relief Organisations (UOSSM), it said. An assailant armed with a knife tried to attack the Israeli embassy in Turkey on Wednesday but was shot before he reached the building, Israel's foreign ministry said."A man approached the embassy with a knife and was shot by a local guard. Everyone on our side is safe," foreign ministry spokesman Emmanuel Nahshon said in a statement."The assailant was wounded in the foot. We don't know if he was attacking police officers or the embassy itself."He added that the assailant reached the "outer perimeter" of the embassy, but said the incident was still being investigated.Turkish media reported two people tried to enter the tightly guarded embassy, with employees taking refuge in a shelter.Initial reports said at least one person was killed, but this was not confirmed.
