New Delhi: Aligarh Muslim University has described as "politically inspired" Modi govt's decision to withdraw the 2006 appeal challenging the Allahabad High Court verdict that the university was not a minority institution.The appeal was filed by the then UPA govt against the 2006 High Court order that struck down an 1981 amendment to the AMU Act, 1920, which said the institution was established by the Muslims and thereby permitting 50% reservation for the community in the university. The said amendment had sought to erase a 1967 judgement by a Constitution Bench of the apex court in the Azeez Basha case, wherein it had said that AMU was not a minority institution. AMU's latest contention was made in an affidavit filed last week in the top court, which was made available on Tuesday.The university assailed the Centre's June 30 affidavit, whereby it conveyed to the top court its decision to withdraw its 2006 appeal against the High Court verdict. AMU affidavit said: "The decision taken after a change of govt at the Centre by the present NDA govt led by a member of the BJP does not appear to be a sound decision based on cogent and valid reasons, but one based on political considerations."It said: "It is well settled that a decision taken at the govt al level will not be nullified by a change of govt after another political party assumes power, particularly when such a decision affects the interest of the nation as a whole."AMU referred to earlier SC judgements in support of its contention. On the BJP-led NDA govt's U-turn on the 2006 decision of its predecessor, AMU said:"In any event, this is nothing but a deliberate dereliction of constitutional duty on the part of the union govt."IANS

After a long wait of 27 years hoping to get maintenance from her husband who had divorced her, a Muslim lady in Maharashtra, got relief from Bombay High Court when it held that that even if the parties are governed by Mohammedan Law and provisions of Muslim Women (Protection of Rights on Divorce) Act, 1986 are applicable, still the maintenance is not required to be confined only to iddat period but till said lady gets remarried. (Rehana Sultana Begum vs. Hashmi Syed Mujib) Justice N.W. Sambre referred to observations by Apex Court in Danial Latifi and another vs. Union of India (2001) 7 SCC 740, 2) wherein it was held that liability of Muslim husband to his divorced wife arising under Section 3(1)(a) of the Act to pay maintenance is not confined to iddat period. The lady had approached High Court against the Magistrate order dismissing her application under section 125 CrPC for future maintenance on the ground that, the parties to the proceedings are Muslims by religion and as such, in view of provisions of Muslim Women Act, 1986 she is not entitled to maintenance beyond Iddat period. The Court held that the lady is entitled for maintenance of Rs.1000/- per month from the date of filing of the application i.e. 22/09/1989. The Court, taking into account of the pendency of her application for more than two decades, granted liberty to move the appropriate Court for modification i.e. enhancement under Section 127 of the CrCp. livelaw.in

Bengaluru: Amnesty International's India chapter on Tuesday said none of its employee had shouted any anti-India slogan at an event on Kashmir in Bengaluru, allegations based on which sedition charges were slapped against the human rights body. Amensty India said allegations mentioned in a complaint by an ABVP representative against it were "without substance" and that only discussion at the event on Saturday was about allegations of human rights violations and denial of justice in J&K."No Amnesty International India employee shouted any slogans at any point," the human rights organisation said in a statement referring to allegations that "slogans were raised that Indian Kashmir should be part of Pakistan."To charges that the event indirectly supported terrorists, Amnesty said the only discussion that had taken place was about allegations of human rights violations and the denial of justice to families in Kashmir."These are issues that have regularly been discussed in the media. They have been written about at length by members of Parliament, politicians, judges and civil society,"it said. The event was held as part of a campaign based on the report "Denied: Failures in accountability for human rights violations by security force personnel in J&K ", published in July 2015, it said.Amnesty said the report was based on in-depth research in J&K, including interviews with family members of "victims", RTI applications, examination of police and court records, and interviews with civil society groups, lawyers, and govt officials.The families of three Kashmiri victims that were interviewed for the report were invited to share their stories at the event, said Amnesty."Towards the end of the event, some of those who attended raised slogans, some of which referred to calls for 'Azaadi' (freedom). Amnesty India as a matter of policy does not take any position in favour of or against demands for self-determination."However, Amnesty considers that the right to freedom of expression includes the right to peacefully advocate political solutions. Srinagar: 5 civilians were killed and at least 31 injured on Tuesday after security forces fired on protesters in two separate incidents in south and central Kashmir taking the death toll to 65 in the valley.According to the police control room in Budgam, four people were killed by CRPF personnel when they opened fire on protesters at Aripanthan area of Beerwah in central Budgam district. At least 15 people were also injured in the firing.In another incident, a man succumbed to a bullet injury in south Kashmir’s Anantnag district. CMO of Anantnag district, Dr Fazil Kochak, told Hindustan Times that the man sustained the injury in a firing by security during a protest in Dehalgam area.Kochak added 16 more people have been injured.The valley has been extremely tense after two people died on Monday and a 10-year-old was critically injured after being hit by a tear gas shell in Bijbehara in south Kashmir’s Anantnag district.16-year-old Yasir Sheikh from Batmaloo area in Srinagar was killed when forces opened fire on protesters in the area on Monday. Ali said Nayeemuddin was a witness in the Sohrabuddin case probe, where he was often referred to as “Kalimuddin”. Lucknow: Taking part in debates on TV by Muslim clerics is un-Islamic and should be avoided, according to a fatwa issued by a prominent Bareilly-based Islamic seminary. The fatwa, issued by the Markazi Darul Ifta of the Dargah Ala Hazrat at Bareilly, said that the Shariat does not permit watching TV or video. “If watching TV and video is barred, then naturally taking part in debates is also not permitted”, said Mufti Mohammed Nazim Ali Quadri, a cleric at the seminary.The fatwa was issued in response to a query by a resident of Shahabad town in the state. He had sought to know if it was appropriate for Muslim clerics to participate in TV debates, especially on those concerning religious issues.Quadri also referred to a book authored by a well-known Islamic scholar to buttress his contention. Mumbai: Agencies investigating terror cases have come across a new trait among youths inclined towards the IS. Youths have stopped using savings accounts in banks and instead are operating current accounts. Reason: they do not want interest on money lying in banks. This characteristic came to their attention while they were probing recent cases involving IS sympathisers, including those who have left the country to join the IS."Police have come across at least 3 such savings accounts which the holder stopped using to begin financial transactions through current accounts," said a police source. A current account is mostly used by businesses for transactions, but it does not earn any returns. According to sources in intelligence agencies, this new information on IS sympathisers may yield leads in future if they start scanning more bank accounts. Sharia prohibits acceptance of interest. However, what many orthodox Muslims with bank accounts do is they give away interest earned from an account to charities. Since it is regarded by sections to be un-Islamic, many Muslims don't even take loans from banks. Shifting from a savings account to a current format is a relatively unknown trend. Police sources said in the light of the recent findings, they may consider looking at bank accounts of potential suspects.TOI
