New Delhi: The Supreme Court on Friday observed that if Islam allowed a man 4 wives, then the husband can marry a 2nd time even without ‘talaq’.Making this oral observation, Chief Justice TS Thakur -- heading a 3-judge Bench -- indicated that prima facie there was nothing wrong in a Muslim man having 4 wives without divorcing the first wife.The Bench, which also included Justice AM Kanwilkar and DY Chandrachud said unless and until the constitutionality of the ‘triple talaq’, permitted under the Muslim personal law, is struck down by court, a man can divorce his wife by pronouncing the phrase thrice.The CJI told V K Biju, counsel for petitioner Ishrat Jahan of Howrah, “We have seen that you have challenged the constitutionality of the ‘triple talaq’. But until it is determined, he (husband) is entitled to have four wives. Even without ‘talaq’, he can marry again.”When counsel complained that her husband had taken away her 4 children and that they should be secured as the police had failed to register an FIR, the CJI asked the petitioner to file a habeas corpus petition in the Calcutta High Court. The Bench, however, issued notice on her petition challenging ‘triple talaq’ and directed this petition be tagged with similar petitions in which the response of the Centre and the All India Muslim Personal Law Board had already been sought. As per sources in the govt, Home Ministry along with some legal advice has decided to book Naik under the UAPA for his speeches. The popular Islamic missionary is accused for motivating the terrorists behind the Dhaka restaurant attack in July this year.“The primary ground for invoking terror charges against Naik are statements by those involved in past terror acts, conceding that they were motivated by his speeches,” said an intelligence officer.Authorities have also decided to impose the UAPA on IRF on the grounds that it is spreading hatred between religious communities. Under the UAPA, an ‘unlawful’ organization is different from a ‘terrorist’ association. The law, while defining an “unlawful association”, covers any organisation “which has for its object any activity that is punishable under Section 153A or 153B of IPC” – provisions dealing with threat to social and communal harmony.Once IRF is declared ‘unlawful’, it might face closure of its offices across the country. Currently, IRF has its head office in Mumbai, runs the Islamic International School in Mumbai and Chennai and own many properties in Mumbai itself. Islamabad:Stepping up Pakistan’s diplomatic offensive, the PM said he has decided to send the parliamentarians for highlighting the Kashmir issue in different parts of the World. Further needling India on the Kashmir issue, Pakistan PM Nawaz Sharif on Saturday nominated 22 parliamentarians as special envoys to be despatched to world capitals to highlight the issue.“We will also remind the UN its long-held promise of self-determination to the Kashmiri people,” Sharif said.“PM urged the special envoys to ensure their efforts for highlighting the Kashmir cause across the world so that he can shake the collective conscience of the international community during his address at the UN this Sept.,” Radio Pakistan reported. “We will also make it clear to India that it was India that approached the UN several decades back on Kashmir dispute but now it is not fulfilling its promise,” he said.The Kashmir problem is the most persistent failure of the UN and that the world body must establish its relevance, he said.“I have decided to send these parliamentarians for fighting the Kashmir cause in different parts of the world.“Generation after generation of Kashmiris have seen only broken pledges and ruthless oppression,” Sharif claimed.He emphasised that this anniversary of the UN ought to be a catalyst, spurring the world body into action.PTI

Police sources said Hurriyat hardliner Geelani was detained at his Hyderpora residence and barred from meeting anybody. Shakeel Ahmad Ganai, the youth killed in Pulwama on Friday , was hit when the security forces acted to foil the 'eidgah chalo' call by imposing strict curfew in Rajpora area. New Delhi:As the diplomatic exchange with Pakistan gets sharper by the day, India is discussing concrete steps to put its new policy on raising human rights violations by Pakistan forces in Balochistan into place, and the External Affairs Minister has been consulting former diplomats on its foreign policy implications.“India has a strong human rights record, and we are naturally concerned about human rights violations in [Balochistan]. Bombay High Court, in a landmark ruling on Friday, allowed entry of women into the inner sanctum of the centuries-old shrine in Mumbai. Mumbai: High Court order lifting ban preventing women from entering Mumbai’s iconic Haji Ali mausoleum has sparked a debate within the Muslim community, as many feel that the court should not have intervened in the religious matter. Others have welcomed the verdict that has been stayed for six weeks after the trust management sought time to approach the SC. Mangaluru: Campus Front of India activists on Saturday carried out protests before the Srinivas College of Pharmacy demanding students be allowed to wear headscarf and enter classes.CFI activist Ashraf alleged students were being harassed for wearing mask in the classroom. They were being forced to remove headscarf while entering classrooms. Students were being threatened of being sent out of college if they do not abide by rules.A student from the first year B.Pharm said while seniors were being allowed to wear headscarf, they were being barred from wearing it. The administration, meanwhile, has shown declaration form that students have signed which states the dress code, which disallows headscarf, jeans and T-shirt in classroom, examination hall, office and library.Another First year B.Pharm student said they have so far not been sent out of the class for wearing headscarf. “But we are taunted when we are found with the headscarf in the classroom. This is a type of harassment,” she said.Principal R. Shabaraya said before admission, the first year B.Pharm students were given declaration. The students and their parents have gone through that and have submitted the form.Shabaraya said students from 2nd to 4th year had not been told this at the time of admission and hence they have been allowed to have headscarf. Meerut: With the process of voter registration for 2017 UP polls set to begin soon, an uphill task is awaiting the Shamli district administration which has to ensure that all the riot-displaced people of neighbouring Muzaffarnagar district make it to the electoral rolls.Activists put the number of displaced people in Shamli at 13,000, a figure which the district administration termed as "exaggerated"."We have been working with Muzaffarnagar riots victims since 2013.Getting their documents in order is an uphill task. After the riots, around 6,000 families were forced to shift their base. Of these, close to 2,800 families came and settled in Shamli district," said Akram Akhtar, project manager of an NGO, Afkar India Foundation."It has been three years to the Muzaffarnagar riots. But around 13,000 people still don't have voter ID cards.These people are not on the electoral rolls, and the elections are almost upon us," Akhtar added.He alleged that the district administration has done several surveys, but skipped the areas where riot-displaced people live. "I think, this was only done out of convenience. I hope that this time, these people will be able to get their names on the list," Akhtar said.When contacted, Shamli DM Sujeet Kumar said several people have been included in the voter list and the 13,000 figure is exaggerated."It is true that some people may not have voter IDs, but the figure of 13,000 people is exaggerated. In a small incident that took communal colour was brought under control by the local leaders and cops to avoid repetition of "Babri Mandi"- where some families had alleged "exodus" due to the fear from "another community."After intervention by community leaders there was a signing of "maafi nama" and "samjhauta patra". The incident involved two people working in the same locality, at the time of opening his shop, a shopkeeper, Kapil Varshney had an argument with a local boy Chandu, son of Jamil. The argument resulted in stone pelting and police stepped in to control the situation. Soon, the local political and community leaders intervened to solve the matter. Allahabad: The Allahabad high court on Friday stayed the arrest of five members of the family of Akhlaq, who was lynched in Dadri's Bisada village last September for allegedly consuming beef, in a cow slaughter case that has been filed against them. Among the 7 booked in the case filed at Jarcha police station are Akhlaq and his immediate family. The high court has given relief to everyone except Akhlaq's brother Jaan Mohammad. Order was given by a division bench of justices Ramesh Sinha and PC Tripathi while hearing a petition filed by Jaan Mohammad and others.The contention of the petitioners was that they had been framed in a false case as on the date of the alleged incident, they had neither consumed beef nor had they stored it in their house. On Sept.28, 2015, a mob had beaten up Akhlaq and injured his son Danish (22) at Bisada on the suspicion that they had consumed beef and kept it in their house. Akhlaq succumbed to his injuries. New Delhi: A Delhi sessions court Friday granted regular bail to JNU Students’ Union president Kanhaiya Kumar and two other students, who have been accused of sedition for raising anti-national slogans during an event at the JNU campus in February this year.Observing that Kumar, Anirban Bhattacharya and Umar Khalid were on interim bail and had “joined the investigation as and when called”, Additional Sessions Judge Reetesh Singh said, “I admit all these accused persons i.e. Kanhaiya Kumar, Anirban Bhattacharya and Umar Khalid to regular bail on the same terms and conditions on which they were granted interim bail.”The court added that existing bail bonds and sureties furnished by the trio at the time of interim bail will remain in force till further orders.

Hyderabad: The tussle between rival groups of the Jamiat-e-Ahle Hadees continued on Friday with the splinter group, Jamiat-e-Ahle Hadees Hyderabad Secunderabad (JAH), accusing the parent body of large scale corruption and siphoning of funds to the tune of several crores.Addressing media persons at the Press Club in Somajiguda, state president of the splinter group, Mohammed Minhajuddin claimed that his panel has raised its voice against "large scale" corruption of the main body and questioned its transparency with regards to collection of funds and their expenditure. Surat: Days after the driver of a tempo carrier was thrashed by a mob allegedly led by “gau rakshaks” on suspicion of carrying cow meat, Surat police on Friday made four arrests in connection with the case. According to police, some youths who claimed to be “gau rakshaks” intercepted the tempo carrier laden with cattle skin and bones at Pandesara in Surat on August 21. Mayor Elisabeth Herzog-von der Heide of the town Luckenwalde, near here, fired the intern after one day because she would not take off her headscarf, The Local reported. “The Islamic headscarf is a means of expressing a religious worldview,” Herzog-von der Heide was quoted as saying.
