New Delhi:A majority of those who had responded to its questionnaire on a uniform civil code, including many Muslims organisations, have opposed spontaneous triple talaq, Law Commission chairperson Justice BS Chauhan has said.The panel is currently examining the more than 40,000 responses it has received to the questionnaire issued in Oct.2016. Justice Chauhan said the larger consensus was that spontaneous triple talaq, as is currently practised, was not in keeping with what was stated in the Shariat, which mandates a three-month iddat period meant for reconciliation and arbitration.“While we are yet to tabulate the huge number of responses, one thing we have observed is that most people, even among the Muslims, have opposed the practice of spontaneous triple talaq. They have held that iddat period should be observed,” said Chauhan.He said, “In Dec.,Justice Mohammad Mustaq of Kerala High Court delivered a judgment examining the validity of triple talaq and sent it to the Law Commission, referring the matter to us. Those who have been alleging that this exercise carries forward the govt’s agenda should understand that with the court order, we are bound to examine the matter now.”At the same time, Chauhan clarified that the commission is not only looking at triple talaq but at the issue of gender justice in personal laws of all religions, in terms of marriage, divorce, child custody and property rights. “Why are we only talking of triple talaq? Except for certain matriarchal societies, such as those in parts of the Northeast, most women still have no right to agricultural land. We will be looking at gender justice in all aspects of personal law. Never before in India has any law commission sought responses from people. This was a first-of-its-kind experiment. Union Urban Development Minister M Venkaiah Naidu on Monday asked parties to stop politicising triple talaq, saying the matter was was sub-judice. Triple talaq is not an “electorate issue” and it should not be linked “with elections and one particular religion,” Naidu said, according to ANI.“There should not be any discrimination, harassment and injustice to any section of people, and more particularly women,” the minister said. “Be it Muslim, Hindu or Christian women, we don’t want anyone to get exploited.” Naidu said the BJP-led govt at the Centre would present its view on triple talaq “when matter the comes up before the Supreme Court”.

New Delhi: Delhi High Court on Monday set up a Judicial Tribunal to look into banning Zakir Naik's NGO IRF under UAPA. A notice has also been issued to IRF to respond to a plea by Ministry of Home Affairs (MHA) to hold in camera proceedings. NIA has also filed 3 affidavits in sealed cover before the Court giving reasons for the ban on IRF.Today was the first hearing of the tribunal and the next hearing will be on Feb.20th.Tribunal headed by Delhi HC judge Sangita Dhingra Sehgal is set to give an order on the schedule of hearings and whether proceedings to be held in closed courtroom on the next date.IRF, earlier moved a petition seeking directions against the ban imposed on it by the central govt.ANI

New Delhi: The Supreme Court has imposed a cost of Rs 30,000 on the Centre for not filing its reply to a PIL alleging that minority benefits are being enjoyed by majority Muslims in J&K .A bench comprising Chief Justice JS Khehar and Justice NV Ramana allowed the counsel for the Centre to file the response after depositing the cost within two weeks and noted that a fine of Rs 15,000 was also imposed last time for the same reason.The bench said it was according last opportunity to the Centre to file the reply.Earlier, the court had issued notice to Centre, state govt and National Commission for Minorities on the plea filed by Jammu-based advocate Ankur Sharma, alleging that benefits accruing to minorities were being taken away by Muslims, who were in a majority in J&K. Spending on education as a share of the central govt 's total budgeted expenditure has been falling for the past three years. Compared to 2013-14, the last year of UPA, when education got 4.57% of the total expenditure, there has been a steady decline — 3.65% in 2016-17, according to this Budget's revised estimate, with the estimated outlay for the coming year showing a minor uptick at 3.71%. Looking at education spend as a share of the GDP, which is what international trackers do, the trend is clear — having dipped from 0.63% of the GDP in 2013-14 to 0.47% projected by the govt for 2017-18.

"In Central Govt jobs the proportion of minorities was 5.3 % in 2014. Today the percentage of minorities in Central Govt jobs is 9.9 % . This is not because of us."We do not agree that they (minorities) did not have the capability. They should have got this right earlier, there must have been differential treatment. We created an environment to end the differential treatment. New Delhi:Alleging political vendetta behind the disappearance of JNU student Najeeb Ahmed, Rajya Sabha member TMC member Vivek Gupta today asked the Centre to order a probe by CBI or any other appropriate agency in the matter. Najeeb had gone missing on Oct.15 following an on-campus scuffle allegedly with ABVP members the night before.Raising the issue during the Zero Hour in the House, Gupta asked the govt whether any special measures have been initiated to trace the missing student.Alleging that the JNU officials were insensitive in the matter, he wondered whether Najeeb will end up just as a statistics about missing persons.Gupta said the ABVP students allegedly involved in the incident have not yet been questioned. He also claimed that VC of the University had even refused to meet the mother of the missing student. “This a clear case of political vendetta. Within a day of 3 names being shortlisted, allegations are being made that AMU had violated the Union HRD ministry's directive issued last year that UGC Regulations, 2010, should not be violated while shortlisting names for the post of VC.AMU's court had finalised the three names out of 5 sent by its executive council on Saturday. 3 shortlisted for the post of VC are Tariq Mansoor, principal, Jawaharlal Nehru Medical College, AMU; Abu Saleh Sharif, executive director and chief scholar, US-India Policy Institute, Washington, and Shahid Jameel, CEO, Welcome Trust and DBT India Alliance.Mansoor was also in the earlier panel of names shortlisted for VC's post. However, the entire panel had got scrapped. Sharif had played a crucial role in the writing of the landmark Sachar Committee report on the state of Muslims. He was also head of National Council for Applied Economic Research.However, even before the shortlisted names were sent to the President for the final selection, a section within AMU has started raising questions.
