Lucknow: Centre is likely to take "a major step" to ban triple talaq after the ongoing assembly polls, Union Law Minister Ravi Shankar Prasad has said and dared SP, Congress and BSP to make their stand clear on the contentious issue. Insisting that the issue is not related to religion but involves respect and dignity of women, he said the government "respects faith but worship and social evil cannot co-exist".He said the tradition of triple talaq denies respect for women and the central govt is committed to end the "evil social practice". "Govt may take a major step to ban triple talaq after the UP Assembly polls," he said while addressing a press conference in Ghaziabad.Asserting that "every pernicious practice" cannot be part of a religion, the minister, who is a lawyer himself, said the Centre would raise the issue in the Supreme Court on three points -- justice, equality and dignity of women."We are the only party which respects women. Neither do other parties offer a good place to women nor do they respect them," said Prasad, a senior BJP leader."Govt respects faith but worship and social evil cannot co-exist," he said.He said, "I want Akhilesh Yadav, Rahul Gandhi and Mayawati to clarify their stand on the issue of triple talaq. Mumbai:A special court has given interim permission to retired Major Ramesh Upadhyay, an accused in the 2008 Malegaon blast case, to travel to UP  to fight the upcoming elections. Upadhyay was allowed to contest the polls last month after he expressed his desire to stand from Bairia constituency in his native town Ballia in eastern UP as an independent candidate. Upadhyay had sought permission from the special NIA court to be allowed to travel to UP for a month for campaigning. Special Judge SD Tekale has allowed Upadhyay to travel from Feb. 6 to March 6 along with a police escort party. Upadhyay will have to bear the cost of the escort party team, the court said. Special public prosecutor Avinash Rasal said the court had also set other conditions for his release, including informing the court about where he would stay in UP and details about the people he would live with. indianexpress

Lucknow:All India Ulema and Mashaikh Board, a body representing Indian Sunni Muslims, scholars and clerics has decided to hold public meetings in all districts of UP  to align minorities in favour of Mayawati-led BSP ahead of UP assembly elections. AIUMB president Syed Mohammad Ashraf Kichhouchhwi said, "In the first such meeting in Sambhal road area of Moradabad on Sunday, we will seek people's support for BSP." AIUMB happens to be a representative body comprising 'Sajjada Nasheen' (patrons-in-chief) of dargahs, imams of masjids. According to their website, board advocates rejection of radical Islam. Support to BSP comes at a time when Mayawati is stepping up her Muslim outreach in western UP and spreading it across the state ahead of the crucial assembly polls. Kichhouchhwi said the board was disappointed in the ruling Samajwadi Party for not fulfilling promises it made to the community in 2012. "I was one of the few Muslim clerics who got points like reservations for Muslim, Dargah act and inclusion of Urdu in PCS(J) examination, incorporated in SP's manifesto in 2012 assembly elections. We pursued the state govt  but to no avail and now, the party has removed the points from its current manifesto," he said, adding that the community had been at the receiving end because of poor law and order in the state. The cleric said in Mayawati's regime law and order situation was robust.The board does not have much influence in communally sensitive West UP where Mayawati eyes a strong Dalit-Muslim combine to help her come back to power. Member of Central Haj Committee, Arshad Mian, however, said board may not have presence in Saharanpur where Darul Uloom Deoband is situated, or in Meerut, Baghpat and Bulandshahr but it set up has offices in almost all districts from Agra and to Gorakhpur in the east.TOI

New Delhi:If you don’t vote, then you have no right to question or blame the govt, the Supreme Court has observed.The candid admission of an activist seeking a blanket order to remove encroachments in the country and saying he has never cast his vote, did not go down well with the SC leading it to make the observation. Observing that the court cannot pass a sweeping order on encroachments in a matter involving all states, the bench headed by chief justice JS Khehar said, “One can’t blame the govt  for everything. If a person does not cast his vote, then he has no right to question govt.”The bench, which also comprised justices NV Ramana and DY Chandrachud, said it was not possible for it to look into encroachments sitting in Delhi and asked the petitioner to approach different high courts wherever he saw such encroachments on roads or pavements.PTI

New Delhi : In a bid to check generation of black money, a steep penalty awaits those accepting cash in excess of ₹3 lakh, beginning April 1, to settle any transaction.A ban on cash transaction of more than ₹3 lakh has been proposed in the Budget for 2017-18. Revenue Secretary Hasmukh Adhia said the penalty for doing cash transaction will be steep and the receiver will have to pay an amount equivalent to the cash received. “Supposing you do a transaction of ₹4 lakh in cash, then the penalty would be ₹4 lakh. If you do a transaction of ₹50 lakh, penalty would be ₹50 lakh,” he said, adding that the penalty will be levied on the receiver.So, if someone buys an expensive watch for cash, it is the shopkeeper who will have to pay the tax, he said, adding that the provision is to deter people from doing large cash transactions.People with large sum of unaccounted money usually spend it on holidaying or buying luxury items like cars, watches and jewellery. The new cash curbs will mean that such spending avenues are curtailed, disincentivising people from generating black money. Adhia said that the previously notified rule of quoting PAN for any cash transaction above ₹2 lakh stays. However, the restrictions will not apply to the govt , any banking company, post office savings bank or co-operative bank.PTI

Gujarat high court has asked a family court to decide expeditiously the application of a Muslim woman who wanted a formal divorce deed saying that her husband had given her ‘triple talaaq’.While the couple opted for triple talaaq consensually, the lower court denied a deed of divorce to the applicant Rashidaben Rassiwala under the Civil Procedure Code, saying this kind of talaaq was not legally valid.Justice Sonia Gokani quashed family court’s order and directed it to decide the application afresh in eight weeks.Rashidaben married Abbas Latiwala in 2002. From 2010 they began to live separately, with Abbas marrying another woman.In 2015, Rashidaben filed a suit for a deed of divorce to formalise the ‘triple talaq’ given by her husband. Abbas endorsed her claim that they were divorced by mutual consent, using the triple talaaq procedure under the Sharia law.The family court, however, rejected the application saying the ‘triple talaaq’ had no legal validity, and she had not furnished a clear proof of divorce. Rashidaben then moved the HC, which in its order on Jan.25 set aside the family court’s order.“The petitioner lady is educated and is working as a teacher. The husband has already remarried after they separated. There is no dispute with regard to the fact that word ‘talaq’ has been thrice uttered,” the HC said, also noting that it had spoken to the couple to ascertain their wishes.“They both needed this decree for the purpose of preparation of official documents. In absence of any provision like section 13-B of Hindu Marriage Act when decree by mutual consent is permissible...they adopted this (course of action),” HC observed.The woman's advocate Aliasghar Zabuawala said, "With this judgment, Muslims can also avail of speedy court processes, otherwise they have to wait for years together to get a divorce decree, without which people are handicapped in applying for govt  documents."PTI /TOI

Rajasthan state human rights commission chairperson Justice Prakash Tatia on Saturday sought public views on the rights of women and children under live-in relationships.He has allocated two months for receiving the views and suggestions of the people on the issue.“I believe that this was an important issue affecting the society and opportunity should be given to the people to provide their suggestions and opinions on this issue,” he said.Suggestions and opinions can be submitted either on the commission’s website or send by post to its Jaipur office. The panel will proceed with a detailed report on the basis of these suggestions and submit the same to the central govt to help it in policy decisions or formation of a law.PTI

New Delhi:The police are merely a law enforcing agency having nothing to do with the constitutional validity of any statutory provision, the city police has told the Delhi High Court hearing a PIL seeking decriminalisation of beef consumption in the national capital. The Delhi Agricultural Cattle Preservation Act provisions prohibit slaughter, transport or export and consumption of cattle meat and beef and provide punishment for a term which may extend to five years and fine up to Rs 10,000.“We (Delhi Police) are a law enforcing agency and we do not deal with the constitutionality of the provision under challenge before this court,” the counsel for the police told a bench headed by Chief Justice G Rohini while responding to the plea seeking decriminalisation of beef consumption in New Delhi. The court was hearing the plea by a law student and an NGO seeking setting aside of the provisions of the Delhi Act which criminalise possession and consumption of beef. Meanwhile, Delhi govt has sought time to respond to the plea by May 8, the next date of hearing.The plea claimed that the provisions of the Act were “a case of legislative over-reach”. It has contended that “prohibition on possession and consumption of beef per se as under the Act is in violation of the fundamental rights of the petitioners and other similarly situated persons, as it infringes on their personal liberty” and causes “hostile discrimination having no nexus with the objects of the Act”.“ Right to eat the food of one’s choice is an integral part of the Right to Life and Liberty,” PIL said,adding that Constitution “mandates state not to make law towards enforcement of a particular religious practice”.PTI

And yet, statistically speaking, you have produced almost no jihadis — I am talking about global jihadis — and that begs an explanation. Maybe one answer is that Indians outside of Kashmir feel that they have a stake in the political system, that even though they are discriminated against and don’t feel that they get enough share of the pie, they nonetheless are engaged in it and, therefore, don’t feel the need to become radical, unlike Muslims maybe in other countries whose frustration can only be addressed through violence. The other interesting thing about the Indian Muslims is that they haven’t joined the fighting in Kashmir.”

Bengaluru: A delegate from Kerala was evacuated from a cinema hall on Saturday night for refusing to stand up when the National Anthem was played at one of the shows of the ongoing 9th edition of Bengaluru International Film Festival (BIFFES).There was commotion for some time because of the heated argument between the delegate and organisers.The delegate refused to stand up when the National Anthem was played during the screening of Train Driver’s Diary by Serbia’s Milos Radovic. The screening commenced an hour late when organisers succeeded in sending the delegate out of the hall, acceding to the objections raised by some in the audience. According to eye witnesses, the delegate had said that he had stood up for National Anthem before every show since the morning. “I have stood up 4 times for the anthem so far and cannot stand again one more time. How many times in a day does an Indian have to prove his patriotism? Is patriotism a thing of exhibition?” he had argued. New Delhi: Central Information Commission has directed the PMO to “initiate fresh efforts” to find out the historical facts about the national anthem and national song after the latter refused to answer an RTI query on the same, claiming that the information did not pertain to it. The query was filed by Harinder Dhingra who wanted the PMO to “certify if ‘Jana Gana Mana’ was the national anthem and ‘Vande Mataram’ the national song, besides completing the file noting on declaration of Rabindranath Tagore’s poem as the national anthem.”PTI

Delhi: Members of the JNUSU continued with their indefinite hunger strike on Saturday, a day after the varsity’s steering committee said it was going back to its old rules for admission for MPhil and PhD.Members of JNUSU, on the fifth day of their hunger strike on Saturday, claimed that the change in admission rules was released as a press note without proper deliberation and approval by members, as per protocol.They added that they will continue to fight the UGC gazette notification that proposed seat cuts and gave 100% weightage to viva voce under a new set of admission rules.On Saturday, JNUSU president Mohit K Pandey and general secretary Satarupa Chakraborty said that students’ body also concerned about the fact that the new admission guidelines do not mention anything about the relaxation of 50% in entrance exams for people who are eligible for reserved quotas. Aligarh: A special meeting of the AMU Court, the supreme governing body of the Aligarh Muslim University, has recommended a panel of three names to the President of India, in his capacity as Visitor of the University, for the appointment of next V-C.The meeting of the Court recommended Professor Tariq Mansoor, Principal and CMS, Jawaharlal Nehru Medical College and Hospital; Dr Abusaleh Shariff, Executive Director and Chief Scholar, US-India Policy Institute, Washington and Dr Shahid Jameel, CEO, Welcome Trust and DBT India Alliance. Prof Tariq Mansoor secured 94 votes, Dr Abusaleh Shariff secured 90 votes and Dr Shahid Jameel secured 86 votes while Prof Javaid Akhter, AMU Registrar secured 84 votes and Prof Mazahir Kidwai, VC of IIMT University, Meerut secured 36 votes. Mumbai : Even after being acquitted from the Sunil Joshi murder case, the process to transfer the Hindu right wing terrorist Sadhvi Pragya to Mumbai for the pending trial of 2008 Malegaon blast case, is yet to begin.Sadhvi, the prime accused in the Malegaon blast case, was acquitted on Wednesday from the murder of RSS leader Sunil Joshi. She is currently admitted in a hospital in Bhopal due to poor health.NIA has been pulled up during the bail application by the Mumbai Sessions court for failing to produce evidence against her. Earlier, advocate Rohini Salian had also accused the NIA of pressurising her to go slow on the Hindu accused in the case. New Delh:NSG “didn’t pay heed” to pleas for rescuing defence guards under fire from gunmen during last year’s Pathankot airbase attack, an air force officer’s statement to the NIA has revealed.“I heard an RT (radio transmission on a wireless set) in which some DSC (defence security corps) personnel was yelling ‘one is dead and two are wounded, please somebody come (to) evacuate us, else we would die.”I then asked Brigadier (Gautam) Ganguly (NSG officer leading the commando team) to get one team prepared for rescue to which he didn’t paid (sic) heed to,” said the officer, wing commander Abhijit Sarin, who was asked to guide the NSG team sent to neutralise the attackers.DSC is under the administrative control of the defence ministry and guards installations under it.HT

New Delhi: Religious leaders in India, especially the Muslims, have a major role in promoting religious harmony, Tibetan spiritual leader Dalai Lama said on Saturday. “Indian religious leaders, especially the leaders of Muslim community, have a major role in promoting religious harmony,” elderly Buddhist monk said while addressing over 400 Indian students and scholars at a teaching session organised by Vidyaloke here. He said in India, concepts such as ‘ahimsa’ have existed for more than 3000 years. “It’s time for Indians to activate these principles for the benefit of the entire human family.” “Indians should take more active role in promotion of inner values, as it is a part of the ancient Indian tradition,”he said.IANS

Hyderabad: State Information Commission has directed the Telangana govt  to come clean on the status of the report which the V Bhaskarao Rao Commission had filed in connection with the police firing in the aftermath of the Mecca Masjid blast.The commission was dealing with an appeal filed by Right to Information activist S Q Masood who had sought documents such as the terms of reference of the commission, a copy of the report and in case this is not possible, a physical inspection of the documents. In its order, the commission noted that the respondent —General Administration (Law and Order) Department — had not sent its representative to a hearing. TOI

In the wake of the latest report of Delhi Minorities Commission on actual representation of minorities in govt departments, Jamaat-e-Islami Hind has demanded the BJP-led NDA govt  of PM Modi to set up Equal Opportunities Commission (EOC) whose draft was approved by the Cabinet of Congress-led UPA govt  in Feb 2014.In its annual report 2015-16, the Delhi Minorities Commission has revealed that the representation of minorities is very small in almost all departments of Delhi.  Commenting on the report, Nusrat Ali, Vice President of Jamaat said the negligible presence of minorities is not only in Delhi govt  departments but in every field in every state across the country.“This (imbalance) is not just true for Delhi but it is fact that at ground level across the country, the representation of minorities is very less in every field from politics to education and other areas,”he said and stressed that Equal Opportunities Commission, a recommendation made by Sachar Committee in 2006, could be a remedy.“Sachar Committee recommended that an Equal Opportunity Commission should be formed.So that minorities get representation in various departments according to their population. Haridwar:Union Home Minister Rajnath Singh has said that a referendum must be conducted in Pakistan to check whether their citizens want to remain there or want to merge with India. Singh also asserted that Kashmir was always with India and will remain a part of it. “Now Pakistan wants referendum on Kashmir but one thing is clear that Kashmir was with India and will be with India and no power can change that. Kozhikode: Giving a rude jolt to the unified Mujahid movement, A Asagar Ali, the organizing secretary of the Kerala Nadvathul Mujahideen (KNM) has relinquished the post.Sources said that Asgar Ali offered to step down after a section of the organisation blasted him in the social media following the publication of an article in Vichinthanam, the official organ of the KNM.Asgar Ali, a senior leader of Markazu Dawa faction, authored the article in collaboration with Abdul Rehman Salafi, an important figure in rival TP Abdulla Koya Madani group.The two groups had announced the merger at a public meeting held on December 20. There were allegations that the two groups hurriedly decided to merge without solving basic ideological issues. One of the issues that remained unaddressed was the question on 'Sihr' (black magic) on which there are divergent opinions within the Muslim community. Markazu Dawa faction held that the belief in 'Sihr' was a superstition that needs to be opposed but the rival group maintained that 'Sihr' will have an impact on human beings. Meanwhile, Wisdom Global Islamic Mission, another splinter group of Mujahids that was outside the purview of the merger, has intensified the campaign against the 'unity without ideology' of the two Mujahid groups.

The decision from the US Court of Appeals for the Ninth Circuit means the ban will remain frozen throughout the weekend, and that a decision on a further request to restore the ban will be put off until at least Monday afternoon. The justice department filed an appeal on Saturday to reinstate an executive order barring citizens from seven mainly Muslim countries and temporarily banning refugees, even as travellers raced to enter the country while the ban was lifted.
