 A Pakistan International Airlines plane with 47 people on board crashed on Tuesday in a hilly area near the garrison town of Abbottabad while on its way to the capital. ATR plane PK-661 with 47 people, including singer-turned-Islamic-preacher Junaid Jamshed, on board crashed near Havelian while en route to Islamabad from Chitral in Khyber-Pakhtunkhwa province.The national carrier's flight departed from Chitral around 3.30pm and was expected to land at Islamabad's International Airport at 4.40pm.A PIA spokesman confirmed that the pilot of the ill-fated plane had given a 'mayday' distress call to traffic control+ before it went off the radar."ATR aircraft flight had 42 passengers, including nine women and two infants, along with 2 air hostesses and three pilots," he said.District Police Officer Abbottabad confirmed the aircraft crashed near Havelian between Majab and Piplian. Eyewitnesses were quoted as saying by media reports that they had seen a plane crash in a hilly area near Havelian.

Delhi:Can the National Commission for Minority Education Institution (Commission) grant minority status to an educational institution? The Supreme Court decided on Tuesday to examine this issue as it issued a notice to the govt on the commission’s plea against a Calcutta high court judgment that held it did not have the power to decide questions relating to status of an institution.The top court’s ruling will have a direct bearing on the status of Delhi-based Jamia Millia Islamia, which was declared a minority institution by the commission in 2011.Its minority status has been challenged before the Delhi high court, currently seized with the matter. NDA govt is expected to support a petition challenging the minority status given to Jamia. Attorney General Mukul Rohatgi has already advised the Ministry of human resource and development that Jamia is not a minority institution.Section 7 of the Jamia Millia Islamia Act of 1988 states that “the University shall be open to persons of either sex and of whatever race, creed, caste or class, and it shall not be lawful for the University to adopt or impose on any person any test whatsoever of religious belief or profession in order to entitle him to be admitted therein as a teacher or student...”Appearing for the commission before SC, senior advocate Sanjay Hegde said the power vested with the commission was not merely appellate in nature, as the HC held. It can confer a minority status as per the 2004 law under which the commission was set-up. The HC ruling the said power was with the “Competent Authority” appointed by the state, which the commission wasn’t.Hegde contended the Competent Authority can grant a NOC, while the commission actually recognises an institution as ‘minority institution’. The HC has confused the power of the competent authority with that of the commission.“The HC returned the fallacious finding since it confused itself regarding the grant of “NOC” by the Competent Authority with that of declaration ‘minority status’ by the Commission. This distinction existing in the Act was erroneously found blurred by the HC,” the appeal read.“Thus, the correct position of law is that the scope of power given to Competent Authority under is very limited to granting NOC, whereas it is the function of the Commission Act to declare and grant minority status,” it said. New Delhi: A 3 judge bench examining whether AMU was a minority institution or not will also hold hearing on a plea challenging the appointment of Lt.Gen. Zameeruddin Shah (retd.) as its V-C.The bench of Chief Justice TS Thakur, Justice DY Chandrachud and Justice L. Nageswara Rao sent the matter to the bench headed by Justice Jagdish Singh Khehar as Shah argued that the challenge to his appointment as VC could not be divorced from the question of the varsity's minority status.Directing the hearing on Jan. 10, Chief Justice Thakur said:"We will direct its hearing (challenge to the appointment of Shah) along with that (of the minority status of AMU). Let it not go in cold storage."The bench headed by Justice Khehar is hearing a 2006 plea by then UPA govt contesting Allahabad High Court verdict striking down the 1981 amendment to the AMU Act, 1920, which held that the AMU was an institution established by the Muslims in India.The amendment sought to override a 1967 top court constitution bench judgment in Azeez Basha case wherein it had said that AMU was not a minority institution. However, Modi govt  has already moved the court seeking to withdraw the petition.In the course of the hearing on Tuesday, counsel Prashant Bhushan told the bench that AMU was bound by the UGC regulations providing that a person to be appointed as V-C should be a distinguished academician, having highest level of competence, integrity, morals and institutional commitment. Bhushan appeared for Syed Abrar Ahmed who has challenged the Oct. 16, 2015, judgment of the Allahabad HC refusing to quash appointment of Shah. However, senior counsel Salman Khurshid, appearing for Shah, told the court that UGC regulations could not override AMU Act which lays down a procedure for the selection and appointment of V-C.He told the court that general regulations can't have an overriding effect on the specific statutes governing AMU alone.Senior counsel Raju Ramachandran appearing for the AMU told the court that VC was not a teacher but an officer looking after the affairs of the university.IANS
India pledges aid to UN agency for Palestinian refugees

New Delhi:India, on Wednesday, pledged an aid of USD 1.25 million to the UN relief agency for Palestinian refugees as it voiced concern over the fragile situation and ongoing conflicts in Middle east region that is aggravating problems of refugees. A total of 20 donors today announced contributions, or their intention to contribute, to the 2017 budget of the UN Relief and Works Agency for Palestine Refugees in the Near East (UNRWA). India made a confirmed pledge of 1.25 million dollars in annual contribution to the agency.First Secretary in India’s Permanent Mission to the UN, Mahesh Kumar said during a meeting of the agency’s Ad Hoc Committee on Dec.5 that “regrettably” an amicable solution to the Palestinian issue has not been found and as a result the refugee population’s expectation to lead a normal life is also not fulfilled.“The current fragile situation and the ongoing conflicts in the Middle East region has compounded the problem of refugees,” he said. Kumar noted that UNRWA, which has provided critical assistance to Palestinian refugees, is facing unprecedented financial and operational challenges. He reiterated India’s support for the just cause of Palestine and solidarity with the Palestinian people.UNRWA has been providing health, education, relief and social services, and emergency humanitarian assistance to some 5.3 million Palestinian refugees across its 5 fields of operation — Jordan, Lebanon, Syria, the West Bank and the Gaza Strip — for 65 years.PTI

Srinagar: Physicians for Human Rights (PHR), a US-based international organization of health professionals, has accused the J&K Police and paramilitary forces of “excessive use of force” and “obstructing access to urgent medical care for protestors” during 5 month street protests in valley.In its report, ‘Blind to Justice – Excessive Use of Force and Attacks on Healthcare in J&K’ released today, the group has said that the excessive use of force against the civilians in valley “violates India’s obligations to protect the rights to life and health”. “Accounts from doctors and media reports show that Indian security forces deliberately obstructed access to urgent medical care for protesters, and harassed medical workers attempting to treat protesters, including by preventing doctors from reaching the hospitals where they work. Further, every doctor interviewed by PHR stated that police, both uniformed and in plainclothes, were present at hospitals and monitored protesters being admitted for treatment.They said police sometimes asked for the names and registers of patients admitted at the end of the day, and used the information to arrest those injured on the grounds that they had participated in ‘unlawful assemblies,'” the report reveals. PHR has been working in the field for more than 30 years. A Nobel laureate for peace, PHR has been using Science and Medicine to document and call attention to mass atrocities and severe human rights violations. Report says that PHR experts, along with other independent policing experts, conducted a review and analysis of the use of the 12-gauge shotgun and the standard operating procedures regulating their deployment in the field. “Experts found that 12-gauge shotgun is inherently inaccurate, indiscriminate, and capable of penetrating soft tissue even at a distance. In general, kinetic impact projectiles – a class of weapon that includes 12-gauge shotgun firing cartridges of pellets – should not be used for crowd management or for crowd dispersal as most of these weapons cannot be used safely or effectively against crowds. At close range, the lethality and patterns of injuries of weapons firing cartridges of pellets or rubber bullets become similar to those of live ammunition,” it says.“Term “pellet gun” is misleading when used to describe the shotguns used by Indian security forces in Kashmir. “Pellet gun” typically denotes the compressed air guns used in other parts of the world for recreational purposes. Unlike these pellet guns, which use compressed air to create force, 12-gauge shotguns used by Indian security forces use explosive powders,which are more powerful and can be lethal”.indian express

Leaders of the two factions of separatist amalgam Hurriyat Conference issued a joint statement asking people from outside to visit the Valley reminding them of the "exemplary hospitality" extended by the Kashmiris."We have been taught hospitality, humanity and safeguarding the rights of guests," the statement said. Washington:Top American lawmakers have expressed concern over the alleged curbs imposed by India on a Christian charity organisation whose representatives appeared before a Congressional hearing seeking change in New Delhi's policies related to foreign funding of NGOs. "It is my hope that by bringing attention to this issue, as we're doing here today, the 145,000 children will not be tragically denied the services they desperately need, and that American families....can continue to send USD38 a month for food and education fees to the poorest of the poor," Congressman Ed Royce, Chairman of the powerful House Foreign Relations Committee said in his opening remarks.Royce joined by other lawmakers and representations of human rights bodies and Compassion International (CI) -- Christian charity organisation which is often accused of being engaged in religious conversions in India -- rued that recent effort to regulate foreign funding and enforce taxation laws has made it impossible for them to carry out work among poor children in India. "In India, it (CI) is the single largest contributor of aid for children living in extreme poverty," Royce said. "We have spent 9 months and hundreds of hours dealing with the Indian bureaucracy on this, and it looks like the bureaucracy is trying to run out the clock," Royce said.TOI

New Delhi:  Several organisations demanding punishment to persons guilty for demolition of Babri Masjid today took out a march and held rally at Jantar Mantar on its 24th anniversary. Political and social activists representing nearly 30 organisations besides students, women, and youth marched from Mandi House to Jantar Mantar holding placards.They also raised slogans demanding punishment for people guilty for demolition of Babri mosque in Ayodhya, anti-Sikh riots of 1984 and other communal violence in the country. "The rally represents the unity of action of all justice-loving and democratic people, who are fighting for their democratic and human rights," said Birju Nayak of Lok Raj Sangathan. Ayodhya: Marking 24 years of the Babri Masjid demolition, temple town of Ayodhya observed 'Shaurya Diwas' (day of bravery) as well as 'Yaum-e-Gham' (day of sorrow).The day passed off peacefully under tight security arrangements. However, about half a dozen activists of right-wing organization Hindu Mahasbha were arrested as a preventive measure. Faizabad SSP Anant Dev said the arrests were made near the disputed site of Babri Masjid-Ramjanmabhoomi to maintain peace and communal harmony. Turnout at both Yaum-e-Gham and Shaurya Diwas meetings was very low. Members of both communities did not show interest in the gathering and spent the day as a routine one. New Delhi: An 'apology' tendered to the Supreme Court by SP leader Azam Khan - for calling a gang-rape incident "a political conspiracy" - was rejected today by the court because it felt it "was not an unconditional apology". Khan, who had infamously said the Bulandshahr gang-rape in July was a conspiracy to malign UP's SP govt , then said he would use the word "remorse" in a fresh affidavit that the top court demanded.To that offer by Khan, the Supreme Court said it would "examine whether remorse is sufficient for tendering an unconditional apology". New Delhi: In deference to the recent Supreme Court order directing cinema halls to play the national anthem prior to the screening of films, the Union home ministry on Tuesday wrote to the chief secretaries of all states and Union territories asking them to take necessary action in this regard and ensure that the order is followed "in letter and spirit".The home ministry said all cinema halls should play the national anthem before the feature film starts and that all present in the hall shall be obliged to stand up to show respect to the national anthem.TOI

On Monday, NIA had approached special Judge VV Patil seeking the test on Qureshi, employee of IRF. Qureshi, who was also produced before court as per Supreme Court provisions that require his consent to be taken for the test, said he did not want to undergo it.Qureshi, a Navi Mumbai resident, who was employed as a guest manager at IRF, had also told court that he did not want to give any confession to NIA. Kolkata: Even as the demonetisation woes continued to plague common residents, alleged coal mafia don Rajesh Jha alias Raju (46), along with promoters and truck owners from the Raniganj coal belt, was nabbed with stacks of new currency in their possession by the Kolkata police STF. The huge cache of arms and ammunition recovered from them has led cops to suspect that the accused were planning to buy arms to spread their net of extortion. Raju was arrested twice in June and July in 2 separate cases of fake currency and murder and was currently on bail.What has made the entire incident murkier is the arrest of a senior BJP functionary identified as Manishi Sharma alias Manish Joshi (44) - who had fought this year's Bengal assembly polls from Raniganj on a BJP ticket - and the recovery of around Rs10 from him. Manish was found travelling in the same car with the other six accused and was caught red-handed with the cash and weapons. IT dept.has been alerted even as cops are trying to ascertain the source of the money kept in Rs 2000 new notes, Rs 100 and Rs 50 notes.
