The Supreme Court has asked the Centre and Muslim women petitioners -- who have challenged the validity of triple talaq -- to suggest a possible way out if the court were to declare the practice unconstitutional.“Where does he (Muslim man) go for divorce? There is no judicial forum for him. There would be a vacuum. How does he seek divorce,” a five-judge Constitution Bench headed by Chief Justice of India JS Khehar asked. The bench – also comprising Justices Kurian Joseph, RF Nariman, UU Lalit and S Abdul Nazeer – asked the Centre and the petitioners to ponder over the possible fallout, in case it declared triple talaq invalid.Justice Joseph said until Parliament enacted a law to address the issue, it could be dealt with under the Dissolution of Muslim Marriages Act, 1939 – under which Muslim women are entitled to seek divorce. Senior counsel Indira Jaising – who appeared on behalf of Bebak Collective – suggested that that the expression “Muslim woman” under the 1939 Act could be replaced by “Muslim person” and it could be made gender-neutral.But most of the grounds for dissolution of a marriage prescribed under Section 2 of the Act were women specific; and not gender-neutral, the bench pointed out.As Justice Nariman said insanity and cruelty were gender-neutral grounds, most of the lawyers burst into laughter.Additional Solicitor General Tushar Mehta said Attorney General Mukul Rohatgi would address the court on all the aspects of the issue on Monday.The arguments would continue on Friday.The court also clarified that the 1939 Act (which covered Shariat) being a statute was a law within the meaning of Article 13(3) of the Constitution and hence could be tested on the touchstone of fundamental rights.At the very outset, the bench said it would not consider the issue of polygamy and concentrate on triple talaq alone.But Mehta insisted that the Centre wanted the court to consider all aspects relating to gender justice. “We are opposing all forms of triple talaq,” he said.Even Jaising said all forms of triple talaq were bad as they conferred unrestricted power on Muslim men to give divorce to women without assigning any reasons. She said unfortunately such unilateral triple talaq were binding and final, she added.The court said it would first determine whether the practice was fundamental to Islam.Senior advocates Kapil Sibal and Raju Ramachandran are representing All India Muslim Personal Law Board in the matter. The issue of triple talaq involved personal laws and if the Govt wanted, it could frame a law but it didn’t require court’s interference, Sibal told the court according to HT. Salman Khurshid, who is assisting the court in his personal capacity, termed triple talaq as a "non-issue" saying it is not considered complete without conciliation efforts between husband and wife. New Delhi: Maulana Syed Jalaluddin Umari, President of Jamaat-e-Islami Hind (JIH) and Vice President of All India Muslim Personal Law Board, has expressed apprehension over the efficacy of banning triple talaq. Speaking at the monthly press meet of Jamaat, the JIH Chief said: ’”Banning triple talaq will not benefit Muslim women. Even if tripe talaq is outlawed, those who want to trouble their wives will still continue to do so and stop giving conjugal rights to their wives. This will lead to many complications and jeopardize women’s stature and dignity’’.Maulana Umari reiterated that “the problem of divorced Muslim women has been blown out of proportion and statistics don’t support the claim of this problem being endemic within the Muslim community”.Earlier the Convener of the recently concluded ‘’Muslim Personal Law Awareness Campaign’’ – Muhammad Jafar briefed the media on the achievements of the campaign. He said that the Jamaat’s campaign, which ran from April 23 to May 7 has been extremely successful. Varanasi: Sankatmochan (Hanuman) temple of Patalpuri Math of Daranagar locality echoed with the hymns of the chanting of 'Hanuman Chalisa' on Wednesday. The ordinary looking practice was special as the recital of the hymns, applauding lord Hanuman, was being done by Muslim women who prayed to Sankatmochan (one who removes all threats) for rescuing them from the practice of triple talaq. The prayers are being performed by the activists of Muslim Mahila Foundation in PM Modi's constituency even as the issue comes up for hearing in the Supreme Court today. Women activists recited the 'Hanuman Chalisa' 100 times from the chalisa written in Urdu. "This temple is special (for idol of Hanuman facing south direction) hence we decided to seek the blessings of Hanuman as we have heard that whosoever recites the Chalisa 100 times gets his or her wish fulfilled, which for us is getting rid of the practice of triple talaq," said Nazneen Ansari, national president of the foundation. Muslim devotees at the temple were joined by Indresh Kumar, a leader of RSS of city, along with Pithadishwar of Patalpuri Math, Baba Balak Das.

New Delhi: India must immediately revoke a ban on social media in J&K to guarantee freedom of expression and seek a lasting solution to the decades-long conflict through democratic dialogue, UN said today.A statement released and published by the UN high commissioner for human rights said the gag was a “collective punishment” that didn’t meet the international standards for limiting free speech.“Scope of these restrictions has a significantly disproportionate impact on the fundamental rights of everyone in Kashmir, undermining the Govt’s stated aim of preventing dissemination of information that could lead to violence,” report, authored by 2 UN human rights experts, said.Anger has mounted in the Valley in recent months over a series of viral videos showing alleged human rights excesses by security forces, including a Kashmiri man tied to an army jeep. Hundreds of students and local residents have clashed with police and army personnel, a string of banks have been looted and stone pelting incidents have increased. On April 17, Govt banned 22 social media sites and applications, including Facebook, Twitter and WhatsApp, in an attempt to stop people from spreading rumours and uploading controversial videos. But the ban has been largely ineffective as residents have circumvented the gag using virtual private networks (VPNs). The report said there were already an estimated 31 reported cases of social media and internet bans since 2012 in J&K , noting what seems to be a worrying pattern aimed at curbing protests and social unrest in the region.The experts noted that in 2016, UNHRC condemned such disruptions and called upon states to avoid them.“Denying such access disrupts the free exchange of ideas and the ability of individuals to connect with one another and associate peacefully on matters of shared concern,” said UN Special Rapporteur on the situation of human rights defenders, Michel Forst. hindustantimes

UP has denied permission to prosecute the accused in the 2007 Gorakhpur riots that killed one person and injured several others, the state’s top legal officer told the Allahabad high court today. CM Yogi Adityanath is among the accused for allegedly inciting violence through inflammatory speeches.The development came during hearing into a petition seeking an independent probe into the violence. Mumbai: On the night of Dec.8, 1992, Burhan Parkar left his office on Cadell Road, in Mumbai’s Mahim area, in search of his nephew who had returned from Saudi Arabia just a week ago. There was tension in the air as the Babri Masjid had been demolished two days before. A huge mob of Muslims had gathered opposite St Michael’s Church, but the cops had calmed them down.Parkar was caught in the melee when stones suddenly rained down from the rooftops of buildings dotted along the road.“I felt a sudden sting in my left leg but thought that it must have been one of the stones. I walked a few paces and felt a rush of pain. I had been shot and could not move my bloodied leg,” recalled Parkar.An ambulance rushed him to hospital,where he found his nephew lying injured in one of the beds.“We both survived. However, number of people killed, be it Hindu or Muslim, our neighbours, friends, some of whom were burnt alive, is an unforgettable memory,” said Parkar.The demolition of the disputed Babri Masjid in Ayodhya, rocked city in Dec1992-Jan1993.The lawlessness culminated in dastardly serial bomb blasts on March 12, 1993 killing 257 people and injuring several others.The Supreme Court recently restored the charges of criminal conspiracy against senior BJP leaders LK Advani, Murli Manohar Joshi, and Uma Bharti.SC’s actions, however, are unlikely to expedite the legal process in cases related to violence in the city.“To find witnesses and re-investigate the cases after 25 years is not going to be easy. However, now that the SC has intervened, it should also frame guidelines on handling riot cases,” says Shakil Ahmed, a lawyer-activist, who has been fighting for justice for riot victims. Many families tired of the long-drawn court battles are accepting defeat.“I have been running around courts, govt offices and police stations all these years. Last year, I had a slipped disc which restricted my movement. I am now even contemplating to withdraw case as we cannot go on fighting the legal battle,” said Tahir whose son was killed in the riots. Lucknow: Allahabad high court on Wednesday allowed the amendment application filed in Kashi Vaishwanath temple-Gyanvapi mosque dispute and directed the court registry to list the two connected petitions before the appropriate bench.The order was passed by justice Sangeeta Chandra while hearing two writ petitions filed in decades-old dispute.In the petition filed by Anjuman Intazamia Masjid, Varanasi, the order passed by the lower court was challenged in which the court dismissed the application raising preliminary objection that the mandir-masjid dispute could not be adjudicated by a civil court as it was barred by the law.In another petition filed by Sunni Central Board of Waqf, the order passed by the additional district judge (ADJ), Varanasi, was challenged. Varanasi ADJ had dismissed an application in which the Waqf Board had requested that it should be added as a party to the suit.Sunni Central Board of Waqf pleaded that the dispute had already been decided by the district court in 1942. However, in Sept.1991, the Places of Worship (Special Provisions) Act, 1991, was enacted and later the temple’s Trust filed a civil suit. In the suit filed by the temple Trust, Swayambhu Vishweshwarnath idol is one of the parties and it has been stated that the temple was built by Maharaja Vikramaditya about 2050 years ago. HT

Hyderabad: MIM president Asaduddin Owaisi has written to AP CM N. Chandrababu Naidu to take action against officials responsible for demolition of several mosques in AP over the past one year. In a letter to Naidu, Owaisi expressed concern at demolition of age-old mosques, under the pretext of road widening. He brought to the notice of CM that the demolition of the centuries-old Masjid-e-Abu Bakr, Hazrat Hussain Shah Quadri and Syed Shah Quadri dargah and masjid, Jama Masjid, Hazrat Shah Zahoor Musafir Dargah, Tarapet Masjid and Jannatul Firdous graveyard in Vijayawada have been going on since May last year in the name of road widening works and construction of flyovers and bridges.He told CM that these arbitrary and uncalled-for and unnecessary demolitions of over four century–old mosques, dargahs and graveyards by Vijayawada Municipal Corporation and Krishna district authorities over the last year have caused unease among the Muslim community.He alleged that the authorities have resorted to these arbitrary demolitions in utter violation of laws and ignoring the pleas of AP Wakf Board and protests and resentment of local Muslims. Ajmer: Excise dept in Rajasthan’s Ajmer city refused to act on a Muslim sect’s request to shift a liquor shop located in front of a mosque, saying the prayer house did not exist as no one has heard ‘azaan’ from the building. Dawoodi Bohra community, a Shia Muslim sect, said they had stopped the common practice of using loudspeakers for ‘azaan’, muezzin’s call for prayers, many years ago to avoid disturbing other communities, besides eliminating noise pollution. The incident came weeks after Bollywood playback singer Sonu Nigam sparked a nationwide debate after calling for a ban on loudspeakers for azaan as it disturbed his sleep.“Locals said they have not seen any community performing namaaz at the spot in the last 50-60 years. Also no azaan has ever been heard being called from the spot,” Ajmer north excise inspector DS Singh said in a letter to the secretary of Bohra Community Association.“The complaint seems baseless, imaginary, and based on political ill-will. Jaipur: Jaipur hotel that was sealed around two months back over rumours of serving beef remains closed despite a court order, asking the Jaipur Municipal Corporation (JMC) to unlock it. The order followed a forensic report that established that the meat sample collected from Hotel Hayat Rabbani was not beef.The court observed that the damage the hotel owner, Naeemuddin Rabbani, suffered due to the JMC’s actions could not be compensated with money. “Court passed the order on April 29. We got it on May 3 and gave it to the JMC the same day I even have an acknowledgment receipt,” Rabbani said.

Jaipur: Police have shifted the officer leading the investigation into the lynching of a Muslim dairy farmer last month by alleged cow vigilantes amid mounting criticism of the slow progress in a case that shocked the nation.Jaipur Police told HT on Thursday that the probe into Pehlu Khan’s death on April 1 near Alwar would be headed by a more senior officer.“I have transferred the investigation of the case from the deputy superintendent of police to additional Superintendent of Police of Jaipur Rural police district in the larger interest of the case,” said Jaipur Range IG of police Hemant Priyadarshy.
